Nannies :: Is your family asking you to get the H1N1 Vaccine?

I've been asked on several occasions, lately by some of my clients about the rules on asking their nannies to get the H1N1 vaccination. First off, everyone should know I am not an attorney and cannot answer this from a legal standpoint, however, I can still offer an opinion.

While the debate around the vaccination is widely discussed, I think having the conversation with your nanny is a great idea. Please note that I am not in any way suggesting you are legally entitled to ask your nanny. However, I'm sure if you get a little creative, you can easily find out where your nanny's thoughts are surrounding the vaccination.

Personally, I do not intend on having my daughter vaccinated, so how coukd I expect my nanny to get the vaccine? I think a very fair way of approaching the subject would be to allow your nanny to make that decision on her own...BUT...have him/her understand that if there are any obvious signs of her being ill without having taken the vaccine, she will not be allowed to return to work until all signs of her illness are gone.

Our family did not receive the vaccine and are completely comfortable with our decision. However, because I do run a childcare facility, I did have to refrain from working for several days last month and go to the H1N1 clinic to be properly diagnosed. As it turns out I had a run of the mill virus and wore a surgical mask for a few days when the children were around me.

For H1N1, I would consider it to be a violation of my rights to be asked, with repercussions if I declined, to accept the shot by my family. On the other hand, we all get vaccinations as children, which are maintained over our lives, which I've never had a problem with. So I'm not sure how to feel about this one in particular.
